Terms and Conditions for LanguageLine Prepaid Russian/English Over the Phone Interpretation Service

Language Line Services, Inc. (“Language Line Services”) and you, the Customer (“you”) agree that the terms and conditions shown below will apply to LanguageLine Prepaid Interpretation Service (the “Service”). Language Line Services is a Delaware corporation with its headquarters in the United States at One Lower Ragsdale Drive, Building Two, Monterey, California 93940. Delaware File No. 3010237.

Use of the Service constitutes acceptance of these terms and conditions as well as any amendments published on the website prepaid.languageline.com at the time of purchase and/or use of the Service. Language Line Services is not required to notify you of any changes to these terms and conditions, and you understand and agree that by using the Service you are agreeing to the then-applicable terms and conditions.

Terms of Use

The Service is only available to individuals who can form legally binding contracts under applicable law and is not available to minors under the age of 18 under any circumstances. You cannot use the Service when you are in Russia; you can only use it when you are outside Russia.

To purchase the Service, you must provide your legal first and last name, postal code, credit card information and e-mail address to the third-party payment processor via the website prepaid.languageline.com. Upon your purchase of the Service, your email address will be provided to Language Line Services. By purchasing the Service, you are giving your consent to the transfer of your email address to Language Line Services in the United States for the purpose of communicating the Service phone number and PIN to you. Should you knowingly falsify any of the required information, Language Line Services may terminate your PIN and your access to the Service immediately with or without prior notice.

Fees and Use

Fees for the Service are determined at the time of purchase and are available on the website prepaid.languageline.com.  Fees are quoted and paid in US Dollars.  The price in your local currency will be determined based on the exchange rate when your credit card transaction is settled.

Once you purchase the Service, a Service phone number and PIN will be sent to the email address you provided.  To use the Service, dial the Service phone number and enter your PIN.  It is important that you keep this PIN as it is the only way you can access the Service.  Language Line Services is not responsible if you lose or forget your PIN. Your PIN and your access to the Service are valid for six (6) months from the date of purchase. When your PIN expires, the Service will no longer be available and the contractual relationship between you and Language Line Services will terminate. You agree that you will not allow others to use your PIN, and if you violate this promise, you agree that you will pay for all the charges incurred for such use of the Service.

Interpretation services are available 24 hours a day, 7 days a week.  

Any telephone carrier roaming or cellular minutes charges incurred are your sole responsibility and are not included in the Fees for the Service.

Prohibited Uses

The following uses of the Service are prohibited: the transmission of any message or other material that constitutes an infringement of any copyright, patent or trademark; an unauthorized disclosure of a trade secret; the transfer of any information or technology abroad in violation of any applicable export law or regulation; a violation of Section 223 of the United States Communications Act of 1934, as amended, 47 U.S.C. Section 223, or other criminal prohibitions regarding the use of telephones to transmit obscene, threatening, harassing or other messages specified therein; a libelous or slanderous statement; or a violation of any other applicable statute or government regulation; use of the Service within Russia.

You also agree that you will not, nor will you allow any other person, to re-sell the Service or to use your PIN. This means that you will not provide access to anyone else to use the Service, whether or not you charge for such access.

Language Line Services may terminate or suspend your PIN and your access to the Service if you misuse your PIN or the Service. You agree that Language Line shall have no liability of any kind for terminating or suspending your PIN.

Privacy Policy and Personal Data

Your use of the Service is subject to the Language Line Privacy Policy, found here: https://www.languageline.com/privacy-policy. In addition, while Language Line does not record any calls, our interpreters may be subpoenaed or required by court order to testify about any calls they interpret.

Neither Language Line Services, its affiliates nor its interpreters collect, process or record any personal data. Information provided to complete your purchase, including your credit card information, will be managed and processed by a third-party payment solutions provider, Authorize.net, which is responsible for the collection of any personal data that may be required to manage and process your payment. Your email address is the only data collected by Language Line Services and it is collected solely for the purpose of communicating the Service phone number and PIN to you. Your email address will be deleted when your PIN expires.

Intellectual Property

You do not have any right, license or permission to use, manipulate, or reproduce any of the Language Line Services trademarks, copyrights, content, or other intellectual property rights without the prior written permission of Language Line Services, which permission is solely within the discretion of Language Line Services. You agree that any violation of the foregoing shall cause Language Line Services actual irreparable harm entitling Language Line Services to immediate preliminary and permanent injunctions without having to post a bond, in addition to all other legal and equitable rights to which it may be entitled.

Representations and Warranties

YOU AGREE THAT LANGUAGE LINE IS PROVIDING THE SERVICES “AS IS” AND “AS AVAILABLE” AND MAKES NO REPRESENTATION, WARRANTY OR GUARANTEE, EXPRESS OR IMPLIED, OF ANY KIND ABOUT THE SERVICE, INCLUDING BUT NOT LIMITED TO THE AVAILABILITY, ACCURACY, COMPLETENESS OR TIMELINESS OF ANY INTERPRETATION OR TRANSLATION. LANGUAGE LINE SERVICES SPECIFICALLY DISCLAIMS ANY WARRANTY OR CONDITION OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. YOU UNDERSTAND AND AGREETHAT OVER-THE-PHONE INTERPRETATIONS MAY NOT BE ENTIRELY ACCURATE IN ALL CASES.

Exclusive Remedy and Limitation of Liability

A. FOR PURPOSES OF THE EXCLUSIVE REMEDY AND LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION, "LANGUAGE LINE SERVICES" SHALL BE DEEMED TO INCLUDE LANGUAGE LINE, LLC, ITS AFFILIATES AND SUBSIDIARIES, AND THEIR RESPECTIVE SUCCESSORS, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, SERVICE PROVIDERS, SUPPLIERS, SUBCONTRACTORS, TRANSLATORS AND INTERPRETERS (WHETHER EMPLOYEES OR INDEPENDENT CONTRACTORS) OFTHE FOREGOING, AND "DAMAGES" WILL REFER COLLECTIVELY TO ALL INJURY, DAMAGE, LOSS OR EXPENSE INCURRED. THE EXCLUSIVE REMEDY AND LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION SHALL APPLY UNLESS OTHERWISE PROHIBITED UNDER APPLICABLE LAW.

B. LANGUAGE LINE SERVICES' CHARGES FOR THE SERVICE ARE ESTABLISHED IN RELIANCE ON THE EXCLUSIVE REMEDY AND LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION. YOU AGREETHAT YOU ELECT TO ACCEPT CHARGES CALCULATED ON THIS BASIS, AND AGREE THAT THIS ALLOCATION OF RISK OF LIABILITY IS FAIR, REASONABLE, AND NOT UNCONSCIONABLE. YOU ALSO UNDERSTAND AND ACKNOWLEDGE THAT THE CHARGES FOR THE SERVICE ARE UNRELATED TO THE VALUE OF YOUR BUSINESS OR OTHER PURPOSE OF YOUR TRAVEL, OR THE POTENTIAL FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, AND SPECIAL DAMAGES OR ANY OTHER DAMAGES IN EXCESS OF THOSE ALLOWED BY THIS SECTION. YOU ACKNOWLEDGE THAT YOU HAVE THE RIGHT TO PURCHASE INSURANCE TO COVER ANY ADDITIONAL LOSS OR LIABILITY.

C. IN ACCORDANCE WITH THE UNDERSTANDINGS SET FORTH ABOVE, YOU AGREE AS FOLLOWS:

C.1. LANGUAGE LINE SERVICES' ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY FOR DAMAGES CAUSED BY DEFECT OR FAILURE OF THE SERVICE, OR ARISING FROM THE PERFORMANCE OR NONPERFORMANCE OF THE SERVICE, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT OR TORT (INCLUDING NEGLIGENCE, STRICT LIABILITY OR OTHERWISE), SHALL BE LIMITED TO A CREDIT OR REFUND OF THE CHARGES FOR THE USE OF THE SERVICE WHICH GAVE RISE TO THE CLAIM.

C.2. LANGUAGE LINE SERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, SAVINGS OR REVENUES OF ANY KIND, WHETHER OR NOT LANGUAGE LINE SERVICES HAD KNOWLEDGE, ACTUAL OR CONSTRUCTIVE, THAT SUCH DAMAGES MIGHT BE INCURRED. THIS SUBSECTION C.2. SHALL SURVIVE FAILURE OF AN EXCLUSIVE REMEDY.

Indemnification

YOU AGREE TO HOLD HARMLESS, DEFEND AND INDEMNIFY LANGUAGE LINE SERVICES, ITS AFFILIATES, SERVICE PROVIDERS, SUPPLIERS AND SUBCONTRACTORS, AND EACH OF THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, AGENTS, REPRESENTATIVES, AND EMPLOYEES, FROM AND AGAINST ALL LOSSES, EXPENSES, DAMAGES AND COSTS, INCLUDING REASONABLE ATTORNEYS' FEES, ARISING OUT OF YOUR USE OF THE SERVICE OR THE USE BY ANY THIRD PARTY YOU PERMITTED TO USE THE SERVICE.

Force Majeure

Neither Language Line Services, its affiliates nor their respective successors shall be liable in any way for any loss, damage, delay or failure of performance resulting directly or indirectly from any cause which is beyond Language Line Services' control, including but not limited to: fire, explosion, lightning, pest damage, power surges or failures, strikes or labor disputes, water, acts of God, the elements, war, civil disturbances, acts of civil or military authorities or the public enemy, inability to secure raw materials, product or transportation facilities, fuel or energy shortages, acts or omissions of communications carriers, or any other cause beyond Language Line Services' control whether or not similar to the foregoing.

Miscellaneous

If any provision of these terms and conditions is held to be invalid or unenforceable, such provision shall be severed from these terms and conditions with respect to the matter in question, and the remainder of the terms and conditions shall remain in full force and effect. These terms and conditions shall not be considered an offer, but when accepted by clicking below shall constitute an agreement between the parties.

The waiver by either party of any breach of these terms and conditions shall not operate as a waiver of subsequent breaches of the same or different kind. The failure of either party to exercise any rights under these terms and conditions in a particular instance shall not operate as a waiver of the party's right to exercise the same or different rights in other instances.
